REGULATION OF THE MINISTER OF TRANSPORTATION
NUMBER: KM 19 of 2005

CONCERNING
MECHANIS TO GIE RECOMMENDATION TO OBTAIN FACILITATION OF EXEMPTION AND/OR RELIEF OF IMPORT DUTY ON THE SEVERAL TYPES OF SPARE PARTS, CHASSIS ENGINE BUS FOR PUBLIC TRANSPORTATION, COMPLETELY KNOCK DOWN (CKD) FOR COMMERCIAL TRANSPORTATION AND BUS IN THE FORM OF COMPLETELY BUILT UP (CBU) FOR PUBLIC TRANSPORTATION

THE MINISTER OF TRANSPORTATION,

Considering:

a. that in order to maintain the survival of transportation business as well as in the framework to improve the quality of transportation services it is necessary to pay attention to transportation services;

b. that the government has provided fiscal incentives in the form of import duty exemption on imports of several types of spare parts as well as relief of import duty on chassis engine bus and bus in the form of Completely Built Up (CBU);

c. that based on the considerations as intended in paragraphs a and b, it is necessary to stipulate Regulation of the Minister of Transport concerning Mechanism to Give Recommendation to Obtain Facilitation of Exemption and/or Relief of Import Duty on the Several Types of Spare Parts, Chassis Engine Bus for Public Transportation, Completely Knock Down (CKD) for Commercial Transportation and Bus in the Form of Completely Built Up (CBU) for Public Transport;

In view of:

1. Law Number 14 of 1992 concerning Road Traffic and Transportation (Statute Book Number 49 of 1992, Supplement to Statute Book Number 3480);

2. Law Number 32 of 2004 concerning Regional Government (Statute Book Number 125 of 2004, Supplement to Statute Book Number 4437);

3. Government Regulation Number 41 of 1993 concerning Road Transport (Statute Book Number 60 of 1993, Supplement to Statute Book Number 3527);

4. Presidential Decree Number 9 of 2005 concerning the Status, Duties, Functions, Organizational Structures and Work Flow of State Ministries of the Republic of Indonesia;

5. Decree of the Minister of Transportation Number KM.35 of 2003 concerning People Transportation Operation in the Road by Public Transportation;

6. Decree of the Minister of Transportation Number KM.24 of 2001 concerning the Organization Work Flow of the Ministry Transportation as amended the latest by Decree of the Minister of Transportation Number KM.42 in 2004;

7. Regulation of the Minister of Finance of the Republic of Indonesia Number 22/PMK.010/2005 dated March 10, 2005 concerning the Exemption of Import Duty on Importation Several Types of Spare Parts for Public Transportation;

8. Regulation of the Minister of Finance of the Republic of Indonesia Number 23/PMK.010/2005 dated March 10, 2005 concerning Relief of Import Duty on Importation Bus Chassis with Installed Machine to Make Public Transportation Bus and Completely Knock Down to Make Commercial Transportation;

9. Regulation of the Minister of Finance of the Republic of Indonesia Number 24/PMK.010/2005 dated March 10, 2005 concerning Relief of Import Duty on Importation Bus in the form of Completely Built Up (CBU) for Public Transportation Purposes.

DECIDES

To stipulate:

REGULATION OF THE MINISTER OF TRANSPORTATION CONCERNING MECHANIS TO GIE RECOMMENDATION TO OBTAIN FACILITATION OF EXEMPTION AND/OR RELIEF OF IMPORT DUTY ON THE SEVERAL TYPES OF SPARE PARTS, CHASSIS ENGINE BUS FOR PUBLIC TRANSPORTATION, COMPLETELY KNOCK DOWN (CKD) FOR COMMERCIAL TRANSPORTATION AND BUS IN THE FORM OF COMPLETELY BUILT UP (CBU) FOR PUBLIC TRANSPORTATION

Article 1

Exemption and/or relief of import duty on spare parts and/or chassis engine bus for public transport and/or completely knock down (CKD) for commercial transportation and/or bus in the form of completely built up (CBU) is given to public transport companies who have a valid license and registered in the licensing agency with services:

Article 2

To get the exemption and/or relief of import duty, public transport companies as intended in Article 1 shall file application to the Director General of Land Transportation by attaching requirements:

Article 3

Imports of spare parts and/or chassis engine buses for public transportation and/or completely knock down (CKD) for commercial transportation and/or bus in the form of completely built up (CBU) can only be done by importers who have gained the recommendation of the Director General of Land Transportation.

Article 4

To get a recommendation as intended in Article 3, the importer may file application to the Director General of Land Transportation to complete requirements:

In addition to meeting the requirements as intended in Article 4, to obtain recommendation for release and/or relief import duty on imports of spare parts of motorized vehicles, chassis engine, and the completely built up (CBU) vehicles, the importer shall include a list of public transport companies names that will get facility of release and/or relief import duties.

Article 6

On the policy to give exemptions and/or relief of import duty can be to targeted, Organda can provide input to the Director General of Land Transportation on the need for spare parts and/or chassis engine buses for public transportation and/or bus in the form of completely built up (CBU) and importers are considered feasible.

Article 7

To application of public transport companies as intended in Article 2, and importers application as intended in Articles 4 and 5, which have met the requirements, the Director General of Land Transportation issues a recommendation to obtain exemption and/or relief of import duty on several types of spare parts and/or engine chassis buses for public transportation and/or the completely knock down (CKD) vehicles and/or the bus in the form of completely built up (CBU) to the Minister of Trade.

Article 8

(1) Recommendation as intended in Article 7 for exemption and/or relief of import duty on imports of spare parts of motorized vehicles, chassis engine buses, and completely built up (CBU) vehicles contains information on the:

Article 9

Importers are required to report the importation and distribution of spare parts and/or chassis engine buses for public transportation and/or completely knock down (CKD) for commercial transportation and/or bus in the form of completely built up (CBU) are obtaining exemption and/or relief of import duties to the Director General of Land Transportation.

Article 10

Importer shall sell the goods that obtained exemption and/or relief of import duty to the public transport company which has received a recommendation from the Director General of Land Transportation.

Article 11

Violations of the provisions as intended in Article 10, shall be penalized in accordance with the regulation.

Article 12

Director General of Land Transportation controls the implementation of this regulation.

Article 13

This regulation shall come into force on the stipulation date.
